PRIVACY POLICY

1. SCOPE AND DOCUMENT HIERARCHY

This Privacy Notice explains how Nosh Robotics Inc. ("Nosh," "we," "us" or "our") collects, uses, retains, discloses and protects personal information in connection with:

  • The Nosh cooking robot and its supplied components (the "Device");

  • The Nosh mobile application, websites, cloud services and Accounts;

  • Orders, deliveries, subscriptions, events and product communications; and

  • Support, diagnosis, repair, replacement, return and product-safety activities.

This Notice applies to United States consumers. It does not apply to Nosh employees or job applicants, or to a third-party service governed by its own privacy notice.

The Nosh Terms of Use apply alongside this Notice. If the documents conflict about personal-information handling, this Notice governs. The Nosh Limited Warranty and Repair, Replacement and Return Policy govern warranty coverage and product-service procedures. Applicable law controls any right that cannot lawfully be limited.

The Account Holder must inform Authorized Users and household members that the Device captures and may retain cooking images during active cooking sessions.

2. PERSONAL INFORMATION WE COLLECT

The categories collected depend on the Services, Device features and choices used. The table describes the principal categories and our current retention criteria.

Nosh may also collect information you choose to provide, information from an Authorized User, and information supplied by an integration you authorize.

3. SOURCES OF PERSONAL INFORMATION

Nosh may collect personal information:

  • Directly from you, an Account Holder or another Authorized User;

  • Automatically from the Device, App, website, cookies and similar technologies;

  • From payment processors, delivery providers, retailers and marketplaces;

  • From Service Centers, repair providers and customer-support providers;

  • From security, analytics, cloud-hosting and communications providers; and

  • From third-party integrations you choose to connect.

Nosh does not seek to collect personal information from an integration beyond what is reasonably necessary for the feature you authorize.

4. CAMERA AND COOKING-IMAGE DATA

Camera operation

The Device uses a camera and computer-vision technology to monitor ingredients, cooking progress and recipe execution. The camera operates only during an active cooking session and automatically switches off when the session ends. It is not intended to monitor the surrounding home or operate while the Device is not cooking.

Collection and permitted uses

Cooking images may be transmitted to and retained in Nosh cloud systems. Nosh may process them automatically and, when reasonably necessary, permit review by authorized personnel or service providers subject to confidentiality, security and purpose restrictions. Permitted purposes are:

  • Operating and improving cooking and computer-vision features;

  • Training, testing and improving Nosh cooking, computer-vision and machine-learning models;

  • Monitoring cooking and product performance;

  • Diagnosing errors and investigating product or cooking issues;

  • Providing Support, debugging and repair assistance;

  • Improving reliability and safety; and

  • Meeting legal, security and regulatory requirements.

Prohibited uses

Nosh does not use cooking images for advertising or cross-context behavioral advertising, facial recognition, biometric identification, identity tracking or surveillance of the surrounding home. Nosh does not sell cooking images.

Retention and derived information

Nosh retains cooking images only as long as reasonably needed for the purposes above, then deletes or de-identifies them unless continued retention is required or permitted for legal compliance, safety, security, fraud prevention or dispute resolution. Nosh may retain trained-model parameters, aggregated statistics and de-identified performance information that cannot reasonably be linked to an identifiable individual or household.

Before the camera is first activated, Nosh will provide an in-product camera notice and access to this Privacy Notice.

Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.

6. HOW NOSH USES PERSONAL INFORMATION
 

Nosh may use personal information as reasonably necessary and proportionate to:

  • Provide, operate, maintain and personalize the Device and Services;

  • Execute recipes and improve supported cooking results;

  • Process orders, payments, deliveries, returns, refunds and subscriptions;

  • Measure completed cooking cycles and administer warranty coverage;

  • Train, test and improve cooking, computer-vision and machine-learning models as disclosed in Section 4;

  • Diagnose errors and provide Support, repair and product-safety assistance;

  • Deliver software, recipe, feature and security updates;

  • Protect Accounts, Devices, users and Nosh systems;

  • Communicate transactional, product, safety, service and marketing information;

  • Comply with legal, regulatory, tax and recordkeeping obligations; and

  • Establish, exercise or defend legal claims.

Nosh will not use personal information for a materially incompatible purpose without providing additional notice and obtaining any consent required by law.

7. SENSITIVE PERSONAL INFORMATION

Account credentials and certain recipe, ingredient, dietary or preference information may qualify as sensitive personal information or may reveal health, religion, ethnicity or another sensitive characteristic depending on context.

Nosh uses this information only as reasonably necessary to authenticate users, provide requested cooking and personalization features, improve supported recipes and performance, maintain quality and safety, provide requested Support, or fulfill another disclosed and authorized purpose. Nosh does not use sensitive personal information to infer characteristics for advertising.

8. HOW NOSH DISCLOSES PERSONAL INFORMATION

Nosh may disclose personal information to:

  • Cloud-hosting, storage, security, analytics and model-development providers;

  • Payment processors, lenders and fraud-prevention providers;

  • Delivery, logistics, Service Center and repair providers;

  • Customer-support, communications and notification providers;

  • Professional advisers, auditors, insurers and compliance providers;

  • Government authorities or other parties when legally required or reasonably necessary to protect safety, rights or security;

  • A buyer, successor or transaction participant in a merger, financing, reorganization, bankruptcy or sale of assets, subject to appropriate confidentiality and notice; and

  • Another party at your direction or with your consent.

Service providers and contractors may process information only for contracted purposes and must be subject to appropriate confidentiality, security and data-use restrictions.

9. SALE, TARGETED ADVERTISING AND COOKIES

Nosh does not sell personal information. Nosh does not share personal information for cross-context behavioral advertising and does not use cooking images for advertising.

The Nosh website and App may use essential technologies needed for authentication, security, preferences and core operation, and limited performance or analytics technologies used to understand service reliability. Where law requires consent or an opt-out, Nosh will provide the applicable control.

If Nosh changes its practices to sell personal information, share it for cross-context behavioral advertising or process it for targeted advertising, Nosh will provide the notice, consent mechanism and privacy choice required by law before beginning the practice.

10. DATA MINIMIZATION, RETENTION AND DE-IDENTIFICATION

Nosh limits collection, use and retention to what is reasonably necessary and proportionate for the disclosed purposes. Retention depends on the nature of the information, the feature or Account lifecycle, warranty and product-safety needs, security risks, tax and accounting duties, legal claims, user choices and applicable law.

When information is no longer reasonably needed, Nosh will delete or de-identify it. Backup copies may remain for a limited period until overwritten or isolated from ordinary use. Nosh maintains measures designed to prevent de-identified information from being re-associated with an identifiable person or household, except where law permits testing those measures.

11. SECURITY AND SECURITY INCIDENTS

Nosh uses administrative, technical and physical safeguards designed to protect personal information, including encryption in transit and at rest where appropriate, access controls, authentication protections, security logging and monitoring, vulnerability management, access reviews, backup and recovery procedures, employee confidentiality duties and service-provider security requirements. No system can be guaranteed completely secure.

Nosh investigates suspected unauthorized access, acquisition, alteration, disclosure or loss. If a security incident requires notice under applicable law, Nosh will notify affected individuals and authorities within the legally required period and provide information reasonably required by law. Credible vulnerabilities may be reported to privacy@noshrobotics.co.

12. SECURITY AND SECURITY INCIDENTS

Nosh uses administrative, technical and physical safeguards designed to protect personal information, including encryption in transit and at rest where appropriate, access controls, authentication protections, security logging and monitoring, vulnerability management, access reviews, backup and recovery procedures, employee confidentiality duties and service-provider security requirements. Nosh investigates suspected unauthorized access, acquisition, alteration, disclosure or loss. If a security incident requires notice under applicable law, Nosh will notify affected individuals and authorities within the legally required period and provide information reasonably required by law. Credible vulnerabilities may be reported to privacy@noshrobotics.co.

 

13. YOUR CHOICES AND PRIVACY RIGHTS

Depending on where you live and applicable law, you may have the right to:

  • Know or access personal information Nosh maintains about you;

  • Receive information about its sources, purposes and recipients;

  • Obtain a portable copy of eligible information;

  • Correct inaccurate personal information;

  • Request deletion of eligible personal information;

  • Opt out of sale, sharing, targeted advertising or qualifying profiling;

  • Limit certain uses of sensitive personal information;

  • Withdraw consent where processing is based on consent;

  • Appeal the denial of a privacy request; and

  • Receive equal service without unlawful discrimination for exercising a privacy right.
     

Submitting a request

Submit a privacy request through the App, any request method identified on the Nosh website, or privacy@noshrobotics.co. Describe the right you wish to exercise and provide the Account or contact information reasonably needed to locate relevant records.

Nosh may verify identity and authority before completing a request. An authorized agent may submit a request where law permits; Nosh may require evidence of the agent's authority and direct verification from the consumer. Nosh will acknowledge and respond within the periods required by applicable law.
 

Lawful exceptions

Nosh may deny or limit a request where permitted by law, including when information is reasonably needed to complete a transaction, provide a requested service, administer warranty or recall obligations, protect product safety, prevent fraud, maintain security, debug, comply with law, protect another person's rights, or establish, exercise or defend legal claims. Where required, Nosh will explain the decision and any appeal right.
 

Effect of deletion

Deleting an Account or personal information may remove cloud recipes, preferences, cooking history and Account-linked features. Where an export feature is available, the user should export desired information before deletion.

No waiver of claims. A deletion request does not waive, release or extinguish a warranty claim, safety report, consumer complaint, legal claim or other right. Nosh may retain limited records lawfully needed to investigate an earlier incident, administer warranty or safety obligations, comply with law, or establish, exercise or defend legal claims. Deletion may nevertheless make deleted user-controlled content unavailable as evidence if Nosh was not legally required to retain it.


 

14. RETURNED DEVICES, LOGOUT AND ACCOUNT DELETION

Before returning a Device, the customer must, where technically possible, sign out of the Nosh Account on the Device, unlink the Device as instructed, sign out of third-party accounts, disconnect integrations and remove locally stored personal information the Device permits the customer to remove. The customer must not provide passwords or authentication codes to Nosh or a Service Center.

If a damaged or inaccessible Device prevents logout or unlinking, the customer must notify Support before shipment. After reasonable identity and ownership verification, Support may remotely sign out, unlink or disable access.

When an accepted Return or Replacement is completed and ownership transfers to Nosh, Nosh will normally unlink the Device, perform a factory or equivalent secure reset, erase user-accessible local information and remove locally stored credentials and access tokens. Nosh may act earlier where reasonably necessary for security.

Returning a Device does not automatically delete the Nosh Account or all Nosh-controlled cloud information. Account or cloud-data deletion must be separately requested under Section 11 and is subject to lawful retention exceptions.

 

15. CHILDREN'S PRIVACY

The Services are intended for Account Holders who are at least 18 years old. Nosh does not knowingly collect personal information directly from a child under 13 without legally required parental consent. If you believe a child has provided personal information contrary to this Notice, contact privacy@noshrobotics.co.

Nosh does not knowingly sell or share the personal information of consumers under 16 for cross-context behavioral advertising.

 

16. STATE-SPECIFIC PRIVACY NOTICES

These notices supplement the rest of this Privacy Notice. The law of the consumer's state controls to the extent of a conflict.
 

California

The categories in Section 2 are the categories of personal information Nosh reasonably expects to collect and has collected during the preceding 12 months when the relevant Services were used. Sections 3, 5, 7 and 9 describe the sources, business or commercial purposes, categories of recipients and retention criteria.

California residents may exercise applicable rights to know/access, correct, delete, receive portable information, opt out of sale or sharing, limit qualifying uses of sensitive personal information and receive non-discriminatory treatment. Nosh does not currently sell personal information or share it for cross-context behavioral advertising. Nosh uses sensitive personal information only for permitted operational, safety, security and user-requested purposes and does not use it to infer characteristics for advertising.

An authorized agent may submit a request as permitted by California law. Nosh may verify the consumer's identity, request signed authority or confirm the request directly with the consumer. Nosh does not disclose personal information to third parties for their own direct-marketing purposes in the manner covered by California's Shine the Light law.
 

Texas

Texas residents may exercise applicable rights to confirm whether Nosh processes their personal data, access that data, correct inaccuracies, delete eligible data, obtain portable data, and opt out of targeted advertising, sale of personal data or qualifying profiling. Nosh does not currently sell personal data, process it for targeted advertising or use profiling to make decisions producing legal or similarly significant effects concerning consumers.

A Texas resident may appeal a refusal to act on a request by replying to the decision or emailing privacy@noshrobotics.co with the subject "Privacy Appeal." If an appeal is denied, Nosh will provide any method required by law for contacting the Texas Attorney General.
 

Other states

Residents of other states may have additional rights to access, correct, delete or port personal information; opt out of sale, targeted advertising or qualifying profiling; obtain a list of certain recipients; limit sensitive-data processing; or appeal a decision. Nosh will provide and honor those rights where they apply.

 

17. CHANGES AND EFFECTIVE DATE

The Effective Date of this Notice, and each updated version, is the date on which Nosh digitally signs or otherwise formally approves that version. Nosh may also display the corresponding calendar date on its website, in the App or in the electronic approval record.

Nosh may update this Notice prospectively to reflect changes in law, technology, the Device, the Services or business operations. Nosh will provide reasonable advance notice of a material change where required by law.

Nosh will not apply a materially expanded or incompatible data use retroactively to previously collected personal information without additional notice and any affirmative consent required by law. In particular, Nosh will not retroactively begin selling personal information, using cooking images for advertising or disclosing cooking images for an unrelated purpose without legally required consent.
