Repair, Return & Cancellation Policy  - USA

1. PURPOSE, SCOPE AND POLICY HIERARCHY

Purpose

This Policy explains the procedures, timelines, service options and charges applicable when a Nosh Device requires:

  • Inspection or diagnosis;

  • Repair;

  • Replacement;

  • Return for a refund; or

  • Transportation to or from a service location.

It separates warranty service from voluntary returns. Returning a Device because you changed your mind is different from requesting a remedy because the Device is defective.

Scope

This Policy applies to Nosh Devices purchased for personal, family or household use in the United States from:

  • Euphotic Labs Pvt Ltd;

  • The official Nosh website;

  • An authorized Nosh sales channel; or

  • An authorized third-party retailer.

For a voluntary return of a Device purchased through Amazon or another authorized third-party retailer, that retailer's disclosed return policy may govern the return process and return window.

Purchasing through a third-party retailer does not eliminate any applicable rights under the Nosh Limited Warranty or applicable law.

Relationship with the Limited Warranty

The Nosh Limited Warranty determines:

  • Whether a defect is covered;

  • The applicable warranty period;

  • Warranty exclusions;

  • The remedies available for a covered defect; and

  • Which warranty parts and labor are provided without charge.

This Policy governs the operational process for obtaining those remedies, including diagnosis, service-center appointments, shipping, packaging, home service, repair turnaround, replacement and return logistics.

This Policy does not reduce or replace the Nosh Limited Warranty.

Relationship with the Terms of Use

The Nosh Terms of Use continue to govern matters including:

  • Account use;

  • Software and connected services;

  • Subscriptions;

  • Privacy and cooking-image data;

  • Limitations of liability; and

  • Dispute resolution.

If the documents conflict:

  • The Nosh Limited Warranty governs warranty coverage and remedies;

  • This Policy governs repair, replacement and return procedures;

  • The Privacy Notice governs personal information;

  • The Terms of Use govern all other matters; and

  • Applicable law governs any right that cannot lawfully be limited.

Statutory rights

Nothing in this Policy limits any warranty, refund, replacement, cancellation or other consumer right that cannot lawfully be limited.

Nosh may provide a remedy that is more favorable than this Policy in a particular case without being required to provide the same exception in every case.

2. DEFINITIONS

"Business Day" means Monday through Friday, excluding United States federal holidays and holidays observed by the applicable service location.

"Covered Warranty Claim" means a claim Nosh determines is covered under the Nosh Limited Warranty.

"Device" means the Nosh cooking robot and the components supplied with it.

"Repair" means correcting a Device defect without transferring ownership of another Device to the customer.

"Replacement" means providing another Device as a remedy for an eligible defective, damaged or missing Device.

"Return" means sending a Device back for a refund, purchase cancellation or another remedy that ends the customer's ownership of that Device.

"Service Center" means a Nosh-operated or Nosh-authorized location that accepts Devices for diagnosis or repair.

"Support" means Nosh's customer-support function that receives Support Requests, performs or coordinates diagnosis and, where required, schedules or authorizes physical service.

"Support Request" means a request opened with Nosh Support concerning a Device issue, warranty claim, repair, Replacement or Return.

"Turnaround Time or TAT" means the applicable period described in this Policy, beginning only when the stated starting condition has been satisfied.

3. REQUESTING SUPPORT AND INITIAL DIAGNOSIS

Starting a Support Request

Before dropping off, shipping or arranging collection of a Device, contact Nosh Support through the App, Nosh website or another support channel identified by Nosh.

The Support Request should include, where reasonably available:

  • Customer name and contact information;

  • Proof of purchase;

  • Device serial number;

  • A description of the issue;

  • The date the issue began;

  • Relevant error messages;

  • Photos or videos reasonably needed to understand the issue;

  • Steps already taken to address the issue; and

  • Information about any accident, spill, power event, modification or previous repair that may be relevant.

Device registration may help Nosh process the request but is not, by itself, required to obtain warranty service.

Immediate safety issues

If the Device emits smoke, sparks or an unusual burning smell, experiences uncontrolled heating, causes an electrical shock, or presents another immediate safety risk:

  • Stop using the Device;

  • Switch it off and disconnect power if it is safe to do so;

  • Do not attempt another cooking cycle;

  • Do not open or disassemble the Device; and

  • Contact Nosh Support promptly.

Nosh may instruct the customer not to transport, ship or reconnect a Device that may present a safety risk until safe-handling instructions are provided.

Acknowledgment

Nosh Support will acknowledge a complete Support Request within three Business Days.

The acknowledgment will include:

  • A Support Request or case number;

  • Any additional information required;

  • Initial safety instructions, where applicable; and

  • The next expected step.

An automated acknowledgment does not mean that warranty coverage or a remedy has been approved.

Support diagnosis

Nosh Support will ordinarily diagnose the reported issue before scheduling physical service. Support may use:

  • Information provided by the customer;

  • Device diagnostics and error logs;

  • Software and firmware information;

  • Photos or videos supplied by the customer;

  • A telephone or video support session; or

  • Other diagnostic information permitted under the Terms of Use and Privacy Notice.

Nosh Support will normally complete its initial diagnosis within three Business Days after receiving the information reasonably required for that diagnosis.

Support troubleshooting may include:

  • Restarting or resetting the Device;

  • Installing a software or firmware update;

  • Checking electrical or network conditions;

  • Inspecting removable components;

  • Confirming correct assembly, cleaning or maintenance;

  • Running an authorized diagnostic procedure; or

  • Correcting a configuration issue.

The customer must not perform any action that requires opening the Device, bypassing a safety system or accessing internal electrical or mechanical components.

Outcome of Support diagnosis

After the initial diagnosis, Nosh Support may:

  • Resolve the issue remotely;

  • Request additional information or testing;

  • Arrange shipment of a customer-replaceable part;

  • Authorize drop-off at a Service Center;

  • Authorize shipment to a Service Center;

  • Offer optional home service;

  • Approve a Replacement or Return; or

  • Explain why the issue is not covered by the Limited Warranty.

A Support diagnosis is not necessarily a final warranty determination. Nosh may need to physically inspect the Device before confirming the cause of the issue or whether warranty coverage applies.

Scheduling physical service

If Support determines that physical service is required, Support will select the available service methods and schedule or authorize the appropriate method. A Device must not be shipped or dropped off until Support issues an authorization or confirms an appointment.

Nosh Support will normally provide the applicable authorization, appointment options and instructions within three Business Days after completing the initial diagnosis.

The Support authorization will identify:

  • The approved service method;

  • The Service Center or shipping destination;

  • Packaging and transportation instructions;

  • Items that must be included or removed;

  • Any known charges requiring approval; and

  • The applicable TAT starting point.

Paused TAT

A stated TAT is paused while Nosh or the Service Center is waiting for:

  • Information requested from the customer;

  • Access to the Device;

  • Customer approval of an estimate;

  • Required account or security verification;

  • Removal of food, liquids or unsafe materials; or

  • Another action that the customer must reasonably complete.

The applicable TAT will resume no later than three Business Days after the required action or information is received.

Charges and estimates

Nosh will not charge for Support diagnosis of a suspected Covered Warranty Claim.

If the issue is determined not to be covered, Nosh will disclose any applicable inspection, transportation, labor, parts or home-service charges before beginning a chargeable repair.

Nosh will not perform a chargeable repair without the customer's authorization.

4. SUPPORT-COORDINATED REPAIR, TRANSPORTATION AND TURNAROUND TIMES

Support determines the next step

After completing its diagnosis, Nosh Support will determine whether the issue can be resolved remotely or requires physical service. Support will coordinate any required Service Center appointment, UPS shipment, customer-replaceable part, optional home-service visit, Replacement or Return.

Available options depend on the reported issue, safety considerations, customer location, parts availability and service capacity. The customer may select from the methods offered by Support, but Nosh is not required to offer a method that is unavailable, unsafe or unsuitable for the diagnosed issue.

TAT summary

Unless a different timeline is stated in the Support authorization:

  • Support appointment confirmation: within three Business Days after physical service is authorized;

  • UPS shipping-label delivery: within three Business Days after shipment is authorized and suitable packaging is confirmed;

  • Replacement-packaging dispatch: within three Business Days after payment of the packaging charge;

  • Service Center check-in: within three Business Days after the Device is received;

  • Initial physical inspection: within three Business Days after Service Center check-in;

  • Repair, testing and quality-control target: within five Business Days after Service Center check-in;

  • Repair-delay notice: no later than the end of the fifth Business Day after Service Center check-in;

  • Customer notification after repair: within three Business Days after repair and quality control;

  • Return-shipment dispatch: within three Business Days after repair and quality control;

  • Home-service appointment target: within five Business Days after Support authorization; and

  • Post-visit next-step instructions: within three Business Days after an incomplete home-service visit.

Shipping and transit time are not included in the five-Business-Day repair TAT. A TAT may be paused only as described in Section 3 or where this Section expressly states another starting condition.

Preparing the Device for physical service

Before shipping, dropping off or making the Device available for home service, the customer must:

  • Remove food, ingredients, spices and other loose materials;

  • Empty the water and oil containers;

  • Clean the removable food-contact components;

  • Remove accessories and personal items that Support has not requested;

  • Switch off and disconnect the Device where safe to do so; and

  • Follow the packaging, transportation and safety instructions provided by Support.

Nosh or a Service Center may decline to handle a Device that is unsafe, contaminated, leaking, excessively unsanitary or improperly packaged.

Where permitted by law, Nosh may charge a reasonable cleaning or special-handling fee if the condition is not caused by a Covered Warranty Claim. Support will disclose the charge and obtain the customer's authorization before chargeable work begins.

Service Center drop-off

A customer must receive a Support authorization and appointment confirmation before dropping off a Device. Support will normally confirm the appointment within three Business Days after authorizing physical service.

The Service Center will check in the Device within three Business Days after receipt and will provide or make available a record containing:

  • The Support Request or case number;

  • The Device serial number;

  • The date of receipt and the date of check-in;

  • The accessories received with the Device;

  • The reported issue; and

  • Any reasonably observable external damage or condition.

The repair TAT begins when the Device is checked in, provided the Device is safe to handle and Nosh has the information and approvals reasonably required to begin service.

The Service Center will target completion of its initial physical inspection within three Business Days after check-in.

Nosh's target is to complete inspection, covered repair work, functional testing and quality control within five Business Days after check-in.

The five-Business-Day target assumes required parts are available, the Device is safe and reasonably clean, any chargeable work is approved promptly, and no additional failure is discovered that could not reasonably have been identified during Support diagnosis.

If the repair is not complete by the end of the fifth Business Day, Support will provide a written status update explaining the reason for the delay and a revised good-faith completion estimate. Support will provide another update at least once every five Business Days until the Device is repaired or another remedy is approved.

Support will notify the customer within three Business Days after the Device completes repair and quality control.

UPS shipment to a Service Center

A Device must not be shipped until Support provides an authorization, shipping destination and packaging instructions.

For an authorized Covered Warranty Claim, Support will provide a prepaid UPS shipping label within three Business Days after confirming that the customer has suitable packaging.

The customer may use:

  • The original Nosh shipping packaging, if it has been retained and remains safe and serviceable; or

  • Alternative packaging approved by Support in writing.

If the customer has not retained suitable packaging, Nosh can provide an approved replacement-packaging kit for $50. The charge covers the packaging materials and delivery of the kit to the customer. Nosh will dispatch the kit within three Business Days after payment.

The $50 packaging charge does not apply if Nosh determines that the original packaging was defective, the Device cannot safely be transported using the original packaging, Support requires shipment because of a safety-related defect and offers no other reasonable warranty-service method, or applicable law requires Nosh to bear the packaging cost.

Failure to follow the supplied packaging instructions does not automatically void warranty coverage, but the customer may be responsible for additional damage caused by inadequate or improper packaging.

UPS transit time is not included in the repair TAT. The repair TAT begins when the Service Center receives and checks in the Device.

After repair and quality control, Nosh will dispatch the Device for return shipment within three Business Days and provide available tracking information.

For a claim that is not covered by the Limited Warranty, Support will disclose any applicable outbound or return transportation charges before the customer authorizes service.

Optional home service

Where supported, a customer may ask Support to schedule home service for an additional $110 per visit.

The $110 charge is an optional convenience and visit fee. It does not include parts or labor for a repair that is not covered by the Limited Warranty, work unrelated to the authorized Support Request, electrical, plumbing, internet or home modifications, or additional visits unless expressly stated in the authorization.

For a Covered Warranty Claim, covered warranty parts and labor remain free of charge. The $110 fee applies only because the customer selected optional home service instead of an available drop-off or shipping method.

Nosh will not charge the optional home-service fee if Support requires home service because the Device may be unsafe to transport or because Nosh offers no other reasonable method of performing covered warranty service.

Support will target an available home-service appointment within five Business Days after authorization. If an appointment cannot be offered within that period, Support will notify the customer within three Business Days and offer the earliest available appointment or another available service method.

Home service is not an emergency-response service.

If the Device cannot be repaired during the home-service visit, Support will provide the next service step within three Business Days. The next step may include ordering a required part, scheduling an additional visit, authorizing Service Center drop-off, authorizing UPS shipment, approving a Replacement or approving another remedy under this Policy.

Any additional visit fee or non-warranty charge must be disclosed and approved in advance.

Parts delays

If a required part is unavailable, Support will notify the customer no later than the end of the fifth Business Day after Service Center check-in or, for home service, within three Business Days after identifying the required part.

The notice will identify the required part or part category, the reason for the delay where known, the estimated availability date, the revised estimated repair-completion date and any available alternative remedy.

Support will provide a further written update at least once every five Business Days while the part remains unavailable.

If the delay becomes unreasonable in light of the nature of the defect, safety considerations, parts availability and applicable law, Nosh may approve a Replacement, refund or other legally required remedy.

Statutory rights

The support process, service methods, charges and TATs in this Section do not limit any non-waivable right or remedy available under applicable law.

5. REPLACEMENT ELIGIBILITY AND PROCESS

When Nosh may approve a Replacement

Nosh may provide a Replacement instead of another repair where:

  • A Covered Warranty Claim cannot reasonably be corrected through repair;

  • The Device has experienced repeated failures or unsuccessful repair attempts;

  • A required part is unavailable within a reasonable period;

  • Repair would be impractical or disproportionate to replacement;

  • The Device presents a safety issue that makes further use or repair inappropriate;

  • The Device is lost or materially damaged while in Nosh's or an authorized service provider's custody;

  • Nosh determines that replacement provides the more appropriate customer outcome; or

  • Replacement is required by applicable law.

Subject to applicable law, Nosh may determine whether to repair or replace a Device. A customer may not require a Replacement merely because a particular service method is less convenient.

Nothing in this Section limits a customer's right to a replacement, refund or other remedy where required by applicable law.

Replacement decision

Support will communicate its Replacement decision within five Business Days after Nosh receives the information and, where required, completes the physical inspection reasonably necessary to determine eligibility.

The decision will identify:

  • The Device approved for Replacement;

  • The replacement model or configuration;

  • The Device and components that must be returned;

  • The components that must not be returned;

  • Packaging and transportation instructions;

  • Any applicable charges;

  • Whether the original Device must be received before the Replacement is dispatched;

  • The Replacement TAT starting point; and

  • Any additional action required from the customer.

Approval of a Replacement does not waive the customer's responsibility to return the original Device and the specifically requested components.

Replacement Device

A Replacement Device will be new unless applicable law permits and the customer expressly agrees to another condition.

Nosh may provide:

  • The same Device model;

  • A newer version of the same model; or

  • A new model with materially equivalent or better core cooking functionality.

The Replacement may have a different color, finish, software version, component revision or minor design variation based on availability, provided that its core functionality is materially equivalent or better.

A Replacement may not contain the customer's previous settings, recipes, logs or locally stored information. The customer should preserve any information that the App allows the customer to export before returning the original Device.

Replacement TAT

Support will provide return and Replacement instructions within three Business Days after approving the Replacement.

If Nosh requires the original Device to be returned first, the Replacement TAT begins only after:

  • The Device is received and checked in;

  • The returned serial number matches the approved Support Request;

  • The customer has returned the items requested by Support;

  • The customer has not included prohibited items, food or liquids; and

  • Any required charge or authorization has been completed.

Where an approved Replacement is in stock, Nosh will dispatch it within five Business Days after the Replacement TAT begins.

Shipping and carrier transit time are not included in the Replacement TAT.

If an appropriate Replacement is not in stock, Support will provide an estimated dispatch date within five Business Days after the Replacement TAT begins. Support will provide an additional written update at least once every five Business Days until the Replacement is dispatched or another remedy is approved.

Where offered, Nosh may provide an advance Replacement before receiving the original Device. Any payment authorization, return deadline or other advance-Replacement condition will be disclosed and accepted before dispatch.

Items that must and must not be returned

Support will provide an itemized list identifying exactly what the customer must return.

The customer must return only the Device, components and accessories specifically identified in the Support authorization.

Unless Support expressly instructs otherwise, the customer must not return:

  • Spice containers or the spice box;

  • The oil container;

  • The water container;

  • Food or partially cooked food;

  • Ingredients or spices;

  • Oil, water or other liquids;

  • Consumables;

  • Unrequested accessories; or

  • Personal items.

All food-contact areas and requested removable components must be emptied and reasonably cleaned before shipment.

The customer must comply with the itemized return, cleaning, packaging and safety instructions provided by Support.

A component that Support instructs the customer to retain will not be treated as a missing returned item and will not reduce the customer's approved remedy.

Account logout and data on the original Device

Before returning the original Device, the customer must, where technically possible, sign out of the Nosh Account on the Device, unlink the Device where instructed by Support, sign out of third-party accounts accessible through the Device and disconnect linked integrations.

The customer must not provide Nosh or a Service Center with an account password, third-party password or authentication code.

If the customer cannot complete the logout or unlinking steps because the Device is damaged, non-functional or inaccessible, the customer must notify Support before shipment. After reasonable identity and ownership verification, Support may remotely sign out, unlink or disable account access on the original Device.

Once the Replacement is completed and Nosh accepts the original Device, Nosh will unlink the original Device and perform a factory reset or equivalent secure reset as part of its normal processing. This will erase user-accessible information and account credentials stored locally on the original Device.

Replacement does not, by itself, delete the customer's Nosh Account or information stored in Nosh-controlled cloud systems. The customer may separately request Account or eligible personal-information deletion under the Privacy Notice and applicable law.

Non-compliant or contaminated shipments

If a shipment contains food, ingredients, spices, oil, water, another liquid or a component that Support instructed the customer not to return, Nosh may:

  • Pause the Replacement TAT;

  • Refuse or restrict handling of an unsafe shipment;

  • Require the customer to correct the shipment;

  • Return prohibited items where reasonably practical;

  • Dispose of food, liquids or contaminated materials;

  • Clean or decontaminate the Device;

  • Repair damage caused by the prohibited contents; or

  • Use another reasonable safety or handling procedure.

To the extent permitted by law, the customer will be responsible for reasonable and documented cleaning, decontamination, disposal, additional shipping, handling and repair costs caused by the customer's failure to follow the instructions.

Nosh may deduct an authorized amount from any discretionary refund associated with the Replacement or seek reimbursement from the customer. Nosh will provide an itemized explanation of the amount.

Failure to follow the instructions does not automatically eliminate warranty or statutory rights. However, Nosh may deny a discretionary Replacement or associated voluntary refund where the non-compliance:

  • Caused or materially contributed to damage;

  • Materially contaminated the Device;

  • Created a health or transportation risk;

  • Prevented Nosh from safely inspecting or processing the Device; or

  • Involved returning a different Device or serial number.

Nosh will not be responsible for the loss, damage or disposal of food, consumables, personal items or unrequested components included in the shipment.

Ownership of the original Device

When Nosh accepts the original Device as part of a Replacement:

  • Ownership of the original Device transfers to Nosh;

  • The customer must not attempt to recover, resell or reactivate the original Device;

  • Nosh may inspect, test, repair, refurbish, recycle, destroy or otherwise process the original Device; and

  • Nosh may retain transaction, diagnostic, warranty, safety and other records as described in the Privacy Notice and permitted or required by law.

Ownership of the Replacement Device transfers to the customer upon delivery, subject to any applicable payment or advance-Replacement conditions.

Warranty on the Replacement Device

A Replacement Device does not begin a new warranty period.

It remains covered for the unexpired portion of the original Device's warranty, unless applicable law requires additional coverage.

Any separately purchased accessory, part or service remains subject to its own applicable warranty or terms.

Damage during Replacement delivery

The customer should notify Support within five Business Days after delivery if the Replacement Device arrives visibly damaged, incomplete or materially different from the approved Replacement.

The customer should retain the packaging and provide reasonably requested photographs or other information. Failure to report within five Business Days does not eliminate any right that cannot lawfully be limited.

6. VOLUNTARY RETURNS AND REFUNDS

Scope

This Section applies to a customer who voluntarily returns an eligible Device because the customer no longer wants it.

It does not govern:

  • Repair of a defective Device;

  • Replacement under the Limited Warranty;

  • A Device materially different from what was ordered;

  • Damage occurring before delivery;

  • Cancellation of an order before shipment; or

  • A refund or other remedy required by applicable law.

Those circumstances may be governed by another Section of this Policy, the Limited Warranty, the applicable order terms or applicable law.

Thirty-day return window

A customer may request a voluntary Return within 30 calendar days after the Device is delivered.

The Return Request must be received by Support within the 30-calendar-day period. The Device does not have to arrive at the authorized return location within that period, provided the customer complies with the shipment deadline stated in the Return authorization.

The thirty-day voluntary-return period does not reduce any warranty or statutory right relating to a defective, damaged, unsafe or incorrectly supplied Device.

Voluntary-return eligibility

To qualify for a voluntary Return, the Device must:

  • Have been purchased directly from Nosh or through a sales channel whose return process is governed by this Policy;

  • Be returned using a method authorized by Support;

  • Match the Device and serial number identified in the Return authorization;

  • Include the Device, components, accessories and documentation requested by Support;

  • Be free from misuse, accidental damage and unauthorized modification;

  • Not have been used commercially or contrary to the Documentation;

  • Be reasonably clean and safe to handle;

  • Contain no food, ingredients, spices, oil, water or other liquids;

  • Be returned in the original protective packaging or replacement packaging supplied or approved by Nosh; and

  • Be logged out of the customer's Nosh Account and linked third-party accounts, unless the customer cannot log out because of the reported Device condition and has notified Support.

Reasonable residential use necessary to inspect, set up and evaluate the Device will not, by itself, make the Device ineligible for voluntary Return.

A component that Support instructs the customer to retain will not be considered missing and will not reduce the customer's refund.

Starting a Return Request

Before shipping or dropping off a Device, the customer must contact Support and request a Return authorization.

The Return Request should include:

  • Customer name and contact information;

  • Order number and proof of purchase;

  • Device serial number;

  • Delivery date;

  • Reason for the requested Return;

  • Current condition of the Device;

  • Photographs reasonably requested by Support; and

  • Information about any accident, spill, damage, modification or repair involving the Device.

Support will communicate its initial eligibility decision within five Business Days after receiving the information reasonably required to review the Return Request.

An initial eligibility decision is not final approval of the refund. Final eligibility and the refund amount are determined after Nosh receives and inspects the returned Device.

Return authorization

If the Return Request is initially eligible, Support will provide the Return authorization and instructions within three Business Days after completing the initial review.

The authorization will identify:

  • The Device approved for Return;

  • The authorized drop-off location or shipping method;

  • The items that must be returned;

  • The items that must not be returned;

  • Cleaning and preparation requirements;

  • Account logout and Device-unlinking instructions;

  • Local-data handling and deletion timing;

  • Packaging instructions;

  • The applicable shipping label;

  • The $150 return-processing charge;

  • Any applicable $50 replacement-packaging charge;

  • The deadline for handing the Device to the authorized carrier or drop-off location; and

  • The applicable inspection and refund TATs.

Unless Support approves an extension, the customer must hand over the Device within 10 calendar days after the Return authorization is issued.

A Return authorization may expire if the customer does not meet that deadline. Expiration does not eliminate a right that cannot lawfully be limited.

A Device sent without a Return authorization may be refused, returned to the customer at the customer's expense or processed under instructions subsequently provided by Support.

Items that must and must not be returned

The customer must return only the Device, components, accessories and documentation specifically identified in the Return authorization.

Unless Support expressly instructs otherwise, the customer must not return:

  • Spice containers or the spice box;

  • The oil container;

  • The water container;

  • Food or partially cooked food;

  • Ingredients or spices;

  • Oil, water or other liquids;

  • Consumables;

  • Unrequested accessories; or

  • Personal items.

The customer must retain any component that Support instructs the customer not to ship.

Nosh will not be responsible for loss, damage or disposal of food, consumables, personal items or unrequested components included in a returned shipment.

Cleaning and food-safety requirements

Before returning the Device, the customer must:

  • Remove all food, ingredients, spices and consumables;

  • Drain all oil, water and other liquids;

  • Remove any components that Support instructs the customer to retain;

  • Clean the pan, ingredient tray, stirrer and other requested food-contact components;

  • Wipe accessible food residue from the Device; and

  • Follow all safety, shutdown and preparation instructions provided by Support.

The Device must not be shipped with food, ingredients, oil, water or another liquid inside it or inside any returned component.

Account logout and Device data

Before shipping or dropping off the Device, the customer must, where technically possible:

  • Sign out of the Nosh Account on the Device;

  • Remove or unlink the Device from the customer's Nosh Account where instructed by Support;

  • Sign out of any third-party account accessible through the Device;

  • Disconnect linked grocery, voice-assistant, smart-home or other third-party integrations; and

  • Remove any locally stored personal information that the Device allows the customer to remove.

The customer must not provide Nosh or a Service Center with an account password, third-party password or authentication code.

If the customer cannot complete the logout or unlinking steps because the Device is damaged, non-functional or inaccessible, the customer must notify Support before shipment.

After completing reasonable identity and ownership verification, Support may remotely sign out, unlink or disable account access on the returned Device.

Failure to log out does not automatically eliminate the customer's Return rights. However, it may pause the Return TAT while Support completes the security and account-verification steps reasonably necessary to process the Device.

Automatic deletion after completion of the Return

For purposes of this Section, a Return is completed when:

  • Nosh has received and inspected the Device;

  • Nosh has accepted the Return;

  • The final refund determination has been made; and

  • Ownership of the returned Device has transferred to Nosh.

After the Return is completed, Nosh will, as part of its normal processing:

  • Unlink the Device from the customer's Nosh Account;

  • Perform a factory reset or equivalent secure reset;

  • Erase user-accessible information stored locally on the Device; and

  • Remove locally stored account credentials and third-party access tokens.

Nosh may perform these actions earlier where reasonably necessary to protect account security, personal information or the returned Device.

The customer is responsible for exporting or preserving any information that the App or Device allows the customer to export before the Device is returned. Locally stored information may not be recoverable after the Device is received or reset.

Nosh Account and cloud data

Returning the Device does not, by itself, delete the customer's Nosh Account or all information stored in Nosh-controlled cloud systems.

The customer may separately request:

  • Deletion of the Nosh Account;

  • Deletion of eligible personal information;

  • Disconnection of the returned Device from the Account; or

  • Another privacy request available under the Privacy Notice or applicable law.

A deletion request may be submitted through the App, Nosh website or Support.

Nosh will process the request according to the Privacy Notice and applicable law. Nosh may retain information that is reasonably necessary to:

  • Complete the Return and refund;

  • Maintain transaction, tax and accounting records;

  • Administer warranty and product-safety obligations;

  • Detect fraud, misuse or security incidents;

  • Establish, exercise or defend legal claims; or

  • Comply with another legal obligation.

Nosh may retain deidentified or aggregated information that cannot reasonably be linked to the customer, as described in the Privacy Notice and permitted by law.

Return shipping and packaging

Support will identify the approved Return method and will normally provide a prepaid UPS shipping label within three Business Days after confirming that the customer has suitable packaging.

The customer must use:

  • The original Nosh shipping packaging, if it has been retained and remains safe and serviceable; or

  • Replacement packaging supplied or approved by Nosh.

If suitable packaging is unavailable, Nosh can provide an approved replacement-packaging kit for $50. Nosh will normally dispatch the kit within three Business Days after payment or after the customer authorizes Nosh to deduct the charge from an approved refund.

The customer must follow the packaging and transportation instructions provided by Support. The customer may be responsible for damage caused by inadequate packaging or failure to follow those instructions.

When the customer uses a prepaid shipping label issued by Nosh, responsibility for the shipment transfers to Nosh when the carrier scans the package into its possession. Nosh is not responsible for damage or additional cost caused by prohibited contents, inadequate packaging, or materially inaccurate information supplied by the customer, except to the extent prohibited by law.

Return-processing and packaging charges

For an eligible voluntary Return, Nosh may deduct:

  • A $150 return-processing charge; and

  • A $50 replacement-packaging charge, if Nosh supplied replacement packaging.

These charges do not apply where the Return results from:

  • Receipt of an item materially different from the item ordered;

  • Damage that occurred before delivery;

  • A defect covered by the Limited Warranty; or

  • Circumstances in which applicable law requires Nosh to bear the charge.

Applicable Return charges will be disclosed before purchase and again in the Return authorization.

Inspection

Nosh will normally inspect a returned Device within five Business Days after it is received and checked in.

The inspection may include:

  • Confirming the Device identity and serial number;

  • Recording the components and accessories received;

  • Assessing the physical and operating condition of the Device;

  • Checking for misuse, impact damage, liquid exposure, unauthorized modification, or previous repair;

  • Assessing contamination, food residue, leakage, and sanitation;

  • Reviewing packaging and transit damage;

  • Confirming account and third-party-service links have been removed or disabled;

  • Reviewing available diagnostics and logs; and

  • Confirming compliance with the Return authorization.

If additional inspection is reasonably required, Nosh will notify the customer within five Business Days after receipt, explain the reason, and provide a revised good-faith completion estimate. Nosh will provide another written update at least once every five Business Days until the inspection is completed.

Refund calculation

The starting refund amount is the purchase price actually paid for the returned Device, together with any refundable sales tax.

Where permitted by law and applicable to the Return, Nosh may deduct:

  • The $150 return-processing charge;

  • The $50 replacement-packaging charge;

  • The reasonable value of a component that Support required the customer to return but that was not returned;

  • Reasonable documented cleaning, decontamination, special-handling, or disposal costs;

  • Reasonable documented costs to repair post-delivery damage not caused by a Covered Warranty Claim;

  • Additional shipping or handling costs caused by the customer's material failure to follow the Return authorization;

  • A separately itemized non-refundable service charge disclosed before purchase; and

  • Another adjustment permitted by the applicable purchase terms or law.

Nosh will not deduct for spice containers, the spice box, oil or water containers, or another component that Support instructed the customer to retain.

Original shipping, delivery, installation, or optional service charges are refundable only where the applicable purchase terms or law require a refund.

If Nosh reduces or denies a refund, Nosh will provide a written, itemized explanation.

Non-compliant or contaminated Returns

If a Device is returned with food, spices, oil, water, liquids, prohibited components, unsafe contamination, or inadequate packaging, Nosh may, as reasonably necessary:

  • Pause the Return TAT;

  • Refuse or delay unsafe handling;

  • Clean or decontaminate the Device;

  • Dispose of food, liquids, contaminated consumables, or hazardous materials;

  • Return prohibited components to the customer where practical;

  • Repair additional damage; or

  • Take another reasonable action required for safety, transportation, or inspection.

Where permitted by law, the customer is responsible for reasonable, documented costs caused by the non-compliance. Nosh may deduct those costs from an approved refund or seek reimbursement. Nosh will not charge a stored payment method without the customer's authorization unless the applicable payment terms or law permit the charge.

Nosh may deny a voluntary refund where material contamination, damage, prohibited contents, or other non-compliance creates a health, safety, transportation, or inspection risk that prevents Nosh from safely processing the Return. Nosh may also deny a voluntary refund if the Device serial number does not match the authorization or the Return is materially incomplete because a component that Support required was not returned.

A minor or reasonably correctable deviation does not automatically make the customer ineligible for a refund. Nothing in this subsection limits a non-waivable warranty or statutory right.

Refund TAT and payment method

Nosh will normally communicate the inspection outcome and any proposed deductions within five Business Days after completing the inspection.

Nosh will normally initiate an approved refund within five Business Days after completing the inspection and final refund calculation.

The refund will be issued to the original payment method. If that method is unavailable, Nosh may use another lawful method after reasonable identity and payment verification.

A bank, card issuer, lender, payment processor, or marketplace may require additional time to post or allocate the refund. Financing, credits, promotions, gift balances, and split payments will be handled under the applicable payment terms.

Returning the Device does not, by itself, cancel or prorate a separate subscription. Cancellation and refund rights for a subscription are governed by the applicable subscription terms and law.

Effect of a refund and separate settlements

An ordinary voluntary-return refund completes the Return transaction, ends the customer's ownership of the returned Device, and satisfies Nosh's obligation to return the approved purchase amount. It does not, by itself, release an unrelated claim or a right that cannot lawfully be waived.

If Nosh offers a refund or other payment to resolve a specific dispute, incident or asserted claim, any release of claims must be stated in a separate, conspicuous written settlement agreement that identifies the claims being resolved and becomes effective only after the customer knowingly accepts it.

Nothing in this Policy prevents a customer from reporting to or cooperating with the Federal Trade Commission or another government authority, or limits an authority's enforcement powers.

Denied Returns

If Nosh denies a Return or refund, Nosh will provide written notice that identifies:

  • The reason for the denial;

  • The material inspection findings;

  • Any proposed charge;

  • Whether the Device will be returned to the customer;

  • The available return-shipping method and cost; and

  • How the customer may request reconsideration.

Nosh will normally respond to a complete reconsideration request within five Business Days.

Nosh will retain, return, recycle, or dispose of a denied Return only as permitted by this Policy, the customer's instructions, and applicable law.

Third-party purchases

If the Device was purchased from an authorized retailer or marketplace, that seller's return policy may govern a voluntary Return. The Nosh Limited Warranty and any non-waivable statutory rights remain available according to their terms.

Ownership

Ownership of a returned Device transfers to Nosh when Nosh accepts the Return and approves the refund, unless applicable law provides otherwise.

After ownership transfers, Nosh may inspect, test, repair, refurbish, recycle, destroy, or otherwise process the Device, subject to the account-unlinking and local-data-reset commitments in this Section and applicable law.

7. POLICY ADMINISTRATION, CONTACT AND DISPUTES

Effective Date

The Effective Date of this Policy, and of each updated version, is the date on which Nosh digitally signs or otherwise formally approves that version. Nosh may also display the corresponding calendar date on the website, in the App or in the electronic approval record.

Policy updates

Nosh may update this Policy prospectively to reflect changes in law, safety or security requirements, service methods, logistics, technology or business operations.

The voluntary-return terms in effect when the customer purchases the Device will apply to that purchase. An update will not retroactively reduce an accrued warranty, refund, replacement or statutory right.

Nosh will provide reasonable notice of a material change where required by law. Contact-information corrections and other nonmaterial administrative updates may become effective when the updated version is digitally signed or formally approved and posted.

Dispute resolution

Disputes concerning this Policy are governed by Section 14 of the Nosh Terms of Use, including its informal-resolution process, individual-arbitration provisions, arbitration opt-out, small-claims exception and other stated exceptions.

This Policy does not expand or reduce the dispute-resolution rights stated in the Terms of Use. It does not prevent a customer from reporting to or cooperating with the Federal Trade Commission or another government authority, and it does not limit a right that cannot lawfully be waived.
